Overview
MCTA attorneys secured an order from the Illinois Supreme Court, which vacated the judgment of the Appellate Court, denying the defendants petition for leave a class certification order, with direction that the court address the merits of the defendant’s petition. Among other issues, Defendant’s petition concerned: (1) the extent to which a defendant may be liable for faxes that were sent by a broadcaster who failed to follow defendant’s instructions; and (2) the adequacy of the Plaintiff to serve as class representative. The matter is now scheduled for oral argument before the First District of the Illinois Appellate Court on April 3, 2013.
