Overview
SmithAmundsen represented a trustee in a dispute over distribution and valuation of trust assets valued in excess of $8 million. The assets ranged from farm and vacation properties, guns and jewelry and securities. In this case, the parents of four children set up numerous trusts to provide for their children. After the death of the last grantor, disputes ensued. We represented the trustee in claims of unfair dealing and breach of trust. It was alleged the trustee (one of the children) favored certain kids over others and failed to provide proper accountings and irrationally disposed of trust assets. After 4 years of disputes, final distributions were made.
