Overview

Amundsen Davis defended a condominium owner in a subrogation action seeking over $500,000 in damages for a rooftop grill fire allegedly caused by the owner’s guest. We filed a motion to dismiss premised on an express waiver of subrogation contained in the homeowner’s association bylaws and insurance policy. The plaintiff insurance company did not to oppose the motion and the claims against the condominium owner were dismissed with prejudice.
